Terms of Service

1. Acceptance of Terms
By installing, accessing, or using AEO App ("the Service") through the Shopware Store, you ("Merchant", "you", or "your") agree to be bound by these Terms of Service ("Terms") between you and TunaApps / AntiGravity ("TunaApps", "we", "us", or "our").
If you are accepting these Terms on behalf of a company or other legal entity, you represent that you have the authority to bind that entity to these Terms. If you do not agree to these Terms, do not install or use the Service.
2. Description of the Service
AEO App provides AI-powered Answer Engine Optimization tooling for Shopware merchants, including:
- AI-generated suggestions for product titles, meta descriptions, and JSON-LD structured data
- A publicly accessible AI-readable catalog endpoint for AI search engines
- Bot traffic tracking and analytics dashboard
- Competitor intelligence, shopper question mapping, and content gap analysis
- Export and reporting tools
The Service operates through the Shopware Admin API using installed-app credentials. We do not have access to your customer-facing storefront or order management beyond what is necessary to read and optimize product data.
3. Subscription Plans and AI Credits
The Service is offered on a subscription basis through the Shopware In-App Purchases system. The following terms apply:
- Free Setup Trial: New installations receive a 7-day free trial with 1,000 AI credits and full access to dashboard, readiness, and catalog preview features.
- AI Credits: Credits are consumed when generating or rewriting product content. Credit balances are tied to the merchant's shop and do not transfer between shops.
- Credit Expiry: Unused AI credits expire at the end of each billing cycle. Credits do not roll over unless explicitly stated in your plan description.
- Booster Packs: Additional credits may be purchased at any time without changing your subscription plan.
- Trial Anti-Abuse: The free trial is limited to one trial per Shopware Store ID. Reinstalling the app after a trial has expired will not restart the trial period.
4. Merchant Obligations and Content Responsibility
⚠️ Critical obligation: You must review all AI-generated content before publishing it to your storefront. TunaApps is not responsible for any consequences arising from publishing unreviewed AI-generated content.
By using the AI Product Optimization feature, you acknowledge and agree that:
- Review before publish: All AI-generated content — including but not limited to product titles, meta descriptions, product descriptions, and JSON-LD structured data — is a draft suggestion that must be reviewed and approved by you before being published to your live Shopware storefront.
- AI Hallucination risk: Large language models can occasionally produce inaccurate, misleading, or factually incorrect content ("hallucinations"). You are solely responsible for verifying that generated content is accurate, truthful, and compliant with applicable laws, including consumer protection regulations and advertising standards.
- SEO compliance: You are responsible for ensuring that AI-generated content complies with search engine guidelines (Google Search Quality Rater Guidelines, etc.) and does not constitute spam, keyword stuffing, or deceptive practices.
- Legal compliance: You are responsible for ensuring that product descriptions, pricing claims, and promotional content comply with applicable German and EU consumer protection laws (UWG, PAngV, etc.).
- Intellectual property: You warrant that you have the right to submit product data and content to the Service and that doing so does not infringe any third-party intellectual property rights.
5. Limitation of Liability
📋 Summary: TunaApps provides AI-generated content as a tool, not as professional legal, marketing, or tax advice. We are not liable for business losses caused by AI-generated content errors, AI engine decisions, or service interruptions.
To the maximum extent permitted by applicable law (including § 309 Nr. 7 BGB), TunaApps shall not be liable for:
- Any inaccuracies, errors, or omissions in AI-generated product content, titles, descriptions, or structured data
- Any loss of revenue, business opportunities, or Google/AI rankings resulting from AI-generated content errors
- Any penalties, fines, or legal actions arising from the merchant's decision to publish unreviewed AI-generated content
- Any claims from end-customers arising from product descriptions that were generated or modified by the Service
- Any indirect, incidental, special, consequential, or punitive damages, even if TunaApps has been advised of the possibility of such damages
Where limitations of liability are not permitted by law, our total aggregate liability for any claims related to the Service shall not exceed the total amount paid by you to TunaApps in the 3 months immediately preceding the event giving rise to the claim.
6. Service Availability ("As Is" Provision)
ℹ️ Honest uptime policy: We aim for high availability but cannot guarantee 100% uptime. The Service depends on third-party infrastructure (Cloudflare, Google Gemini API, Shopware). Planned maintenance and unexpected outages may occur.
The Service is provided on an "as is" and "as available" basis. TunaApps makes no representations or warranties of any kind, express or implied, including:
- No guaranteed uptime percentage or Service Level Agreement (SLA) for standard subscription plans.
- No guarantee of continuous, uninterrupted access to the Service.
- No guarantee that AI-generated content will achieve any specific SEO ranking, citation rate, or business outcome.
- No guarantee of compatibility with future Shopware versions or third-party plugins.
TunaApps is not liable for any loss or damages caused by:
- Planned or unplanned downtime of Cloudflare Workers, Cloudflare D1, or Google Gemini API (including HTTP 503 responses)
- Rate limiting or quota restrictions imposed by Google's API infrastructure
- Shopware platform updates that affect app compatibility
- Force majeure events (natural disasters, cyberattacks, government actions, etc.)
We will make reasonable efforts to communicate planned maintenance in advance via the in-app dashboard and/or email notifications.
7. Prohibited Uses
You agree not to use the Service to:
- Attempt to reverse-engineer, decompile, or extract the source code of the Service or its AI models
- Circumvent, bypass, or disable billing systems, credit limits, or access controls
- Use the AI Catalog Endpoint to serve spam, malware, or deceptive content to AI engines
- Attempt to scrape or bulk-export data beyond your authorized plan limits
- Resell, sublicense, or white-label the Service without written permission from TunaApps
- Use the Service in any manner that violates applicable laws or regulations
8. Intellectual Property
TunaApps IP: The Service, including all software, algorithms, UI designs, and documentation, is owned by TunaApps and protected by copyright and intellectual property laws. No license is granted except the limited right to use the Service as described herein.
Merchant content: You retain all ownership rights to your product data, brand information, and content. By using the Service, you grant TunaApps a limited, non-exclusive, royalty-free license to process your product data solely to provide the Service.
AI-generated output: Content generated by the AI based on your product data is provided to you for your use. TunaApps does not claim ownership of AI-generated output derived from your data.
9. Termination and Account Deletion
By Merchant: You may cancel your subscription at any time through the Shopware Admin. Uninstalling the app terminates your subscription and triggers automated deletion of your shop data from our systems within 30 days.
By TunaApps: We reserve the right to suspend or permanently terminate your access to the Service immediately and without prior notice if you:
- Breach any material provision of these Terms
- Attempt to circumvent billing systems or access controls
- Use the Service for fraudulent, abusive, or illegal purposes
- Fail to pay subscription fees after a reasonable grace period
Upon termination, your right to use the Service immediately ceases. Provisions of these Terms that by their nature should survive termination (including Sections 5, 6, 8, and 10) shall survive.
10. Governing Law and Jurisdiction
These Terms are governed by and construed in accordance with the laws of the Federal Republic of Germany, excluding its conflict of law provisions. The United Nations Convention on Contracts for the International Sale of Goods (CISG) does not apply.
For merchants established in the European Union, you may also benefit from mandatory consumer protection provisions of the law of your country of residence.
Any disputes arising from or relating to these Terms shall be subject to the exclusive jurisdiction of the courts of Ho Chi Minh City, Vietnam, unless mandatory law requires otherwise.
11. Changes to These Terms
TunaApps reserves the right to modify these Terms at any time. We will provide at least 30 days' notice of material changes via email or in-app notification. Your continued use of the Service after the effective date of any revision constitutes acceptance of the updated Terms.
If you do not agree to revised Terms, you must stop using the Service and uninstall the app before the effective date of the changes.
